Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and BlackWealthFunds (“BlackWealthFunds,” “we,” “us”) governing your access to and use of blackwealthfunds.com and any related services (the “Services”). By creating an account or using the Services, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and able to form a binding contract. By using the Services, you represent that you meet these requirements and that any information you provide is accurate.

2. Accounts

You are responsible for safeguarding your password and for all activity under your account. Notify us immediately at support@blackwealthfunds.com of any unauthorized use.

3. Membership and payments

Some features require a paid membership or per-post fee. By purchasing, you authorize us and our payment processor (Square) to charge your payment method. Memberships renew automatically until canceled. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period.

Refunds. Membership dues and per-post fees are non-refundable except where required by law. Marketplace purchases between members are subject to the seller’s refund policy.

4. Member-submitted content

You retain ownership of content you submit (business listings, job posts, marketplace items, project proposals, blog comments, messages, files). By submitting content, you grant BlackWealthFunds a worldwide, non-exclusive, royalty-free license to host, display, and distribute it on the Services. You represent that you have the right to submit it and that it does not violate any law or third-party right.

5. Marketplace

The marketplace lets members sell digital products, services, and affiliate links to other members. BlackWealthFunds charges a 20% commission on each completed sale. BlackWealthFunds is not a party to the transaction between buyer and seller and does not guarantee the quality, safety, or legality of items listed. Disputes should first be resolved directly between buyer and seller; we may step in at our discretion.

6. Acceptable use

You agree not to:

• Post unlawful, harassing, defamatory, hateful, or sexually explicit content.
• Impersonate any person or misrepresent your affiliation.
• Promote pyramid schemes, get-rich-quick scams, or unregistered securities.
• Send spam, scrape the Services, or attempt to bypass security or rate limits.
• Use the Services to violate any applicable law.

We may remove content and suspend or terminate accounts that violate these Terms.

7. Intellectual property

The Services, including the BlackWealthFunds name, logo, design, and all software and original content we provide, are owned by BlackWealthFunds and protected by copyright, trademark, and other laws. You may not copy, modify, or distribute them without our written permission.

8. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, express or implied. Information shared in the community, marketplace, learning center, or blog is for general informational and educational purposes only and is not financial, investment, legal, tax, or professional advice. 9. Limitation of liability

To the maximum extent permitted by law, BlackWealthFunds and its directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from your use of the Services. Our total liability for any claim will not exceed the amount you paid us in the 12 months before the claim, or USD $100, whichever is greater.

10. Indemnification

You agree to indemnify and hold BlackWealthFunds harmless from any claim arising out of your content, your use of the Services, or your violation of these Terms.

11. Termination

You can close your account at any time. We may suspend or terminate your access to the Services if you violate these Terms, create risk for us or other members, or for any other reason at our reasonable discretion. Sections that by their nature should survive termination will survive.

12. Governing law and disputes

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

13. Changes

We may update these Terms from time to time. We will post the updated version with a new “Last updated” date and, for material changes, notify you in-app or by email. Continued use of the Services after changes take effect constitutes acceptance.
